General Terms and Conditions (GTC)
These general terms and conditions (GTC) regulate all legal relationships for purchase contracts concluded between SEYU Design KlG (seller) and its customers (buyers) in the online shop (online shop). Terms and conditions of the buyer that conflict with these terms and conditions are hereby expressly excluded.
2. Contractual partner
In the event of a contract being concluded, the contract is concluded with:
SEYU Desin KlG, Schipfe 51, CH-8001 Zurich
Company identification number CHE-347.713.072, registered in the commercial register of the Canton of Zurich in Switzerland.
The seller can be reached via email firstname.lastname@example.org. Orders, inquiries, complaints and other declarations of intent should be sent to this address.
3. Offer and delivery
The offer can be seen on the seyu.ch website and is non-binding. Product information is mainly used for illustration and is non-binding. Price and range changes as well as technical changes remain reserved. The offers are only valid as long as they are visible on the website and while stocks last.
In the online shop, the buyer submits a legally binding offer to conclude a contract by submitting his order and at the same time accepting these terms and conditions. The contract is concluded when the buyer receives an order confirmation from the seller via email. The delivery method and delivery costs are shown in the online shop.
Information on availability and delivery times are not binding. If an item is not available in stock, the buyer will be informed as soon as possible when the delivery can be expected. The seller is not liable for delays in delivery caused by manufacturing companies or third parties. All information about delivery times are therefore without guarantee and can change at any time. Delivery is at the risk and expense of the buyer.
4. Prices and payment
The prices are in Swiss Francs (CHF). The prices and conditions published are subject to change, the day of the order by the buyer being the reference date.
The ordered goods are paid in advance, either by credit card or PayPal. For online payments, the value of the goods will be debited on the day the order is received. The seller reserves the right to exclude buyers from individual payment options without giving reasons. Invoices are payable within 20 days of receipt. The seller reserves the right to request reminder fees of at least CHF 20 as well as further collection fees after the second reminder. The assignment to a collection agency remains reserved.
The delivered goods remain the property of the seller until full payment has been made. The seller is entitled to make a corresponding entry in the retention of title register. If the buyer defaults on paying the purchase price, the seller is entitled, among other things, to withdraw from the contract and to take possession of the goods again.
5. Warranty and liability
Complaints regarding defects or incomplete or incorrect delivery must be reported to the seller in writing immediately, at the latest 14 days from the delivery date. Hidden defects must be reported to the seller in writing immediately, but no later than 14 days after discovery. If the buyer misses the timely notification, his claims expire. After returning the rejected goods, the buyer will receive a replacement delivery if there is a defect. If no replacement delivery is possible, the seller will reimburse the payment made. In addition, any claim for reduction, conversion or compensation for consequential damage, as far as legally permissible, is excluded.
The buyer forfeits any rights to defects in the event of improper use of the goods. Defects resulting from normal wear and tear, as a result of improper handling or damage by the buyer or third parties, as well as defects that can be attributed to external circumstances (improper storage, frost, heat, moisture, incorrect storage, etc.) do not entitle the buyer to withdraw or to Replacement of the goods. The seller assumes no liability for this. Goods are returned at the buyer's expense and risk. The products must be properly packed in the original packaging and sent by registered mail. If the seller is unable to determine any defects that are covered by the warranty or are covered by the manufacturer's guarantee, the seller can invoice the buyer for the costs of testing and shipping the goods.
Other claims of the buyer - regardless of the legal basis - are excluded, as far as legally permissible. The seller, her assistants and any vicarious agents are not liable for damage that has not occurred to the goods themselves, in particular not for consequential damage, loss of profit or other financial loss of the buyer. Any liability of the seller in connection with the offer (in particular incorrect images, texts and prices) and delivery is excluded insofar as the law permits.
6. Cancellation, right of return and cancellation by the buyer
Orders of the buyer are binding and the customer is obliged to accept the service. Subsequent changes at the customer's request are possible at the seller's discretion. The buyer has the right to return the goods within 14 days of receipt and to cancel the contract. The right of return can only be exercised legally if the goods are returned unused, undamaged, complete and in their original packaging. After receipt of the goods returned in the described condition, the seller reimburses the value of the goods to the buyer. The goods are to be returned at the buyer's expense, benefit and risk. Further information on delivery and return can be found in the corresponding link in the footer.
All texts, images, graphics, video and animation files are subject to copyright and other laws protecting intellectual property. They may not be copied, changed or used on other websites without the consent of the seller.
8. Data protection
The seller's data protection declaration applies in its current version, which is available at www.seyu.ch.
The seller can provide the customer with information about other products or services of the seller (e.g. in the form of a newsletter or by letter). If the customer no longer wishes to receive such messages from the seller, he can unsubscribe at any time by email at email@example.com.
9. Applicable law and place of jurisdiction
The seller expressly reserves the right to adapt these terms and conditions at any time and to apply them immediately.
All contracts concluded with the seller are subject to Swiss law, to the exclusion of the substantive standards of conflict of laws and the United Nations Convention on Contracts for the International Sale of Goods (CISG). When ordering private individuals for private use, the place of jurisdiction is based on the consumer protection regulations. In all other cases, Zurich is the exclusive place of jurisdiction.
